The rules for using calm catch.

1. Definitions

In this agreement:

• “calmcatch” or “the App” means calmcatch, including the iOS app, server-side services, and related services;
• “We,” “us,” or “our” means MinLiu, the operator of calmcatch;
• “You” means a user who registers, logs in, accesses, or uses calmcatch;
• “User Content” means tasks, events, notes, ideas, tags, remarks, and other content that you enter, upload, generate, save, or synchronize in calmcatch;
• “AI Organization” means the feature through which calmcatch uses AI capabilities to classify, extract, suggest, summarize, or format the content you enter;
• “Membership Services” means paid subscription services provided by calmcatch, including but not limited to monthly memberships, annual memberships, or other paid benefits.

2. Service Content

calmcatch mainly provides the following services:

1. Quickly record ideas, tasks, schedules, and notes;
2. Automatically distinguish tasks, events, notes, and ideas awaiting confirmation;
3. Suggest start times, durations, tags, or priorities for tasks and events;
4. Provide views such as Today, Calendar, and Notes;
5. Provide advanced features such as statistics, data export, and cloud synchronization;
6. Provide free trials and membership subscription services;
7. Provide other features related to productivity management, task organization, and schedule planning.

We may add, adjust, suspend, or terminate service content based on product planning, user feedback, technical conditions, or operational needs.

3. Account Registration and Use

3.1 Account Registration

You may register or log in to calmcatch through email, Apple sign-in, Google sign-in, or other methods we support. You must ensure that the information you provide when registering and using your account is truthful, accurate, complete, and lawful. If your account information changes, you should update it promptly.

3.2 Account Security

You should properly protect your account, device, verification codes, and login credentials. Actions performed through your account are generally deemed to have been performed by you. If you discover account theft, abnormal login, or security risks, you should contact us immediately. Losses caused by your failure to properly protect account information, devices, or login credentials shall be borne by you, unless the law provides otherwise.

3.3 Account Restrictions

You may not:

1. Register or use an account by impersonating another person;
2. Lend, transfer, or sell an account;
3. Use another person's account;
4. Use an account for illegal, non-compliant, infringing, or service-disrupting activities;
5. Access calmcatch abnormally through automated tools, scripts, crawlers, or similar methods.

If we discover that your account has abnormalities, illegal activity, violations, or security risks, we have the right to take measures such as restricting login, suspending services, deleting violating content, or terminating the account.

4. Free Services and Membership Services

4.1 Free Services

calmcatch may provide free users with a limited number or limited scope of feature experiences, such as:

• Three free trials of AI organization;
• Creating and managing basic tasks, events, and notes;
• Using basic views and basic reminder features.

The specific scope of free services is subject to what is actually shown in the App. We have the right to adjust free benefits based on operational needs.

4.2 Membership Services

Members may receive more complete feature benefits, including but not limited to:

1. Unlimited or higher-quota AI organization;
2. Data export;
3. Usage statistics;
4. Advanced views or advanced filters;
5. Cloud synchronization or backup;
6. Future member-only features.

Membership benefits, prices, periods, trial rules, and limitations are subject to what is shown on the in-app subscription page.

4.3 Subscription Prices

calmcatch may provide the following subscription plans:

• Monthly membership: US$7.99 per month
• Annual membership: subject to the price shown on the in-app subscription page

Specific prices may vary by region, currency, platform, promotion, tax, or exchange rate. The final price is subject to the price shown in the App Store or in-app payment page.

4.4 Automatic Renewal

If you purchase an automatically renewing subscription, the subscription will renew automatically according to platform rules before the end of the current period, unless you actively cancel before renewal. Charges, cancellation, refunds, and billing management for automatic renewal are usually handled by the App Store or other payment platforms. You can manage or cancel subscriptions in the subscription management page of the relevant platform. Deleting calmcatch or closing your calmcatch account will not automatically cancel an automatically renewing subscription opened through the App Store or another platform.

4.5 Cancellation

You can cancel your subscription as follows:

• iOS users: go to the Apple ID subscription management page to cancel;
• Users of other payment channels: follow the cancellation method provided by the relevant payment channel.

After cancellation, you can usually continue to use membership benefits during the current paid period. After the current period ends, membership benefits will automatically stop.

4.6 Refunds

Unless applicable law provides otherwise or the payment platform rules allow a refund, paid membership fees are generally non-refundable. For orders paid through the App Store, refund requests are generally handled by Apple, and we cannot directly decide the refund result.

5. AI Organization Feature

5.1 AI Results Are for Reference Only

calmcatch's AI organization feature is used to help you organize input content. AI may generate tasks, events, notes, start times, durations, or other suggestions based on context. AI output may be inaccurate, incomplete, unsuitable for the current situation, or misunderstood. You should review, confirm, and modify AI-generated results yourself.

5.2 No Professional Advice

calmcatch is not a medical, psychological counseling, legal, financial, investment, or other professional service tool. AI organization results do not constitute professional advice, diagnosis, treatment plans, legal opinions, investment advice, or a basis for decision-making. If you need professional help, please consult a qualified professional in the relevant field.

5.3 User Responsibility

You are responsible for the content you enter, the actions you take after adopting AI suggestions, and the resulting outcomes. To the extent permitted by law, we are not responsible for misunderstandings, omissions, delays, losses, or disputes arising from your reliance on AI results.

5.4 Prohibited Illegal or High-Risk Content

You may not use AI organization to enter, generate, or process the following content:

1. Illegal, violent, terrorist, or extremist content;
2. Content that infringes another person's privacy, reputation, intellectual property, or other lawful rights and interests;
3. Harassing, discriminatory, hateful, threatening, or insulting content;
4. Pornographic, vulgar, or age-inappropriate content for minors;
5. Malicious code, cyberattacks, fraud, or other content that harms cybersecurity;
6. Other content that violates laws, regulations, public order, good morals, or platform rules.

6. User Content

6.1 Content Ownership

The rights and interests in User Content that you create, enter, upload, or save in calmcatch remain owned by you or the original rights holder. You grant us a necessary, non-exclusive, worldwide license to store, process, synchronize, back up, display, and transmit your User Content within the scope necessary to provide calmcatch services. This license is limited to what is necessary to implement calmcatch features, maintain service operation, process your requests, and fulfill legal obligations.

6.2 Content Legality

You must ensure that the content you enter, upload, or save is lawful and truthful and does not infringe any third-party rights. You may not use calmcatch to save, distribute, or process illegal or non-compliant content. If your content causes third-party complaints, disputes, claims, or administrative penalties, you shall bear the corresponding responsibility.

6.3 Content Backup

We will use reasonable efforts to maintain stable data storage and synchronization, but we do not guarantee that data will never be lost. We recommend that you regularly use the data export feature to back up important content. To the extent permitted by law, we are not responsible beyond the scope required by law for data loss or damage caused by network abnormalities, system failures, third-party service abnormalities, user mistakes, force majeure, or similar reasons.

7. Schedules, Reminders, and Notifications

calmcatch may send notifications based on the tasks, events, or reminder times you set. Reminder features may be affected by device system settings, network status, notification permissions, battery management, time zone settings, and other factors. We do not guarantee that every reminder will be delivered accurately or on time. You should not use calmcatch as the only reminder tool for urgent matters, medical matters, legal deadlines, exams, flights, major financial transactions, or other high-risk matters.

8. User Conduct Rules

When using calmcatch, you may not:

1. Violate laws, regulations, regulatory requirements, public order, or good morals;
2. Infringe another person's intellectual property rights, privacy rights, reputation rights, portrait rights, or other rights and interests;
3. Interfere with or disrupt the normal operation of calmcatch;
4. Reverse engineer, decompile, disassemble, or attempt to obtain source code;
5. Bypass membership restrictions, payment restrictions, access restrictions, or security mechanisms;
6. Use plug-ins, scripts, bots, crawlers, or other abnormal methods to access the service;
7. Access, scan, or attack servers or databases without authorization;
8. Upload malicious code, viruses, trojans, or other harmful programs;
9. Impersonate another person or fabricate an identity;
10. Use calmcatch for fraud, spam distribution, illegal marketing, or other improper activities.

If you violate this agreement, we have the right to take measures such as warnings, feature restrictions, account suspension, content deletion, service termination, or pursuing legal responsibility depending on the circumstances.

9. Intellectual Property

calmcatch and its related content, including but not limited to:

• Software code;
• Interface design;
• Icons, logos, and illustrations;
• Product names;
• Copywriting;
• Feature design;
• Data structures;
• Technical solutions;

are protected by intellectual property laws. Except for User Content, the relevant rights and interests belong to us or the lawful rights holders. Without written permission from us or the relevant rights holders, you may not copy, modify, distribute, sell, rent, reverse engineer, or otherwise use any content of calmcatch.

10. Third-Party Services

calmcatch may integrate with or depend on third-party services, including but not limited to:

• Apple sign-in and payment services;
• AI service providers;
• Cloud server and database services;
• Data analytics services;
• Crash monitoring services;
• Push notification services.

Third-party services are provided by their respective operators and are governed by their terms of service and privacy policies. For service interruptions, data abnormalities, payment failures, refund disputes, or other issues caused by third-party services, we will use reasonable efforts to assist, but we are not responsible for third-party services beyond what is required by law.

11. Service Changes, Interruptions, and Termination

We may change, interrupt, or terminate part or all of the services for the following reasons:

1. Product feature adjustments;
2. System maintenance or upgrades;
3. Server, network, or third-party service failures;
4. Security risks or vulnerability fixes;
5. Laws, regulations, regulatory requirements, or requests from judicial or administrative authorities;
6. Force majeure;
7. Your violation of this agreement or related rules.

We will use reasonable efforts to notify you in advance, except in emergencies.

12. Disclaimer

To the extent permitted by law, calmcatch is provided on an “as is” and “as available” basis. We do not promise that calmcatch will meet all of your needs, nor do we guarantee that the service will be uninterrupted, error-free, free from data loss, that AI results will be completely accurate, or that reminders will always be delivered on time.

To the extent permitted by law, we are not responsible for losses caused by:

1. Your misuse, over-reliance on, or misunderstanding of calmcatch features;
2. Your failure to promptly review, confirm, or modify AI results;
3. Your failure to enable notification, calendar, or reminder permissions;
4. Abnormalities in devices, systems, networks, or third-party services;
5. Your active deletion, modification, or overwriting of data;
6. Force majeure or reasons not reasonably within our control;
7. Your violation of this agreement or laws and regulations.

13. Limitation of Liability

To the extent permitted by law, we are not liable for indirect, incidental, special, punitive, or lost-profit damages arising from your use of or inability to use calmcatch. If the law determines that we are liable, our total liability shall not exceed the total amount you actually paid to us for calmcatch during the 12 months before the dispute arose. If you have not paid any fees, the liability cap shall be US$50. These limitations do not apply where the law expressly prohibits limiting liability.

14. Privacy Protection

We value the protection of your personal information and privacy. Please read the calmcatch Privacy Policy to understand how we collect, use, store, share, and protect your information. The calmcatch Privacy Policy is an important part of this agreement.

15. Agreement Updates

We may update this agreement based on product changes, operational needs, or legal and regulatory requirements. If this agreement changes materially, we will notify you through in-app notices, pop-ups, email, or other reasonable methods. The updated agreement takes effect on the effective date shown on the page. If you continue to use calmcatch after the agreement is updated, you accept the updated agreement. If you do not agree with the updated agreement, you should stop using calmcatch.

16. Account Deletion and Service Termination

You can request account deletion in calmcatch or contact us at:

After account deletion, we will stop providing account-related services to you and will process your personal information according to the calmcatch Privacy Policy.

Please note:

1. After account deletion, you may be unable to restore your original account, tasks, events, notes, statistics, and export records;
2. Account deletion will not automatically cancel automatically renewing subscriptions through the App Store or other payment platforms;
3. If you still have unexpired membership benefits, account deletion may prevent you from continuing to use those benefits;
4. Information that laws and regulations require us to retain will be retained according to law.

17. Governing Law and Dispute Resolution

The formation, performance, interpretation, and dispute resolution of this agreement shall be governed by the laws of the place where the service operator is located or the actually applicable jurisdiction, without excluding mandatory rights granted to consumers by the laws of their location. Disputes arising from this agreement or calmcatch should first be resolved through friendly negotiation. If negotiation fails, either party may submit the dispute to a court or dispute resolution body with jurisdiction according to law.

3. 为任务和事件建议开始时间、持续时间、标签或优先级；
4. 提供 Today、Calendar、Notes 等视图；
5. 提供数据统计、数据导出、云端同步等高级功能；
6. 提供免费体验和会员订阅服务；
7. 提供其他与效率管理、任务整理和日程规划相关的功能。

我们可能会根据产品规划、用户反馈、技术条件或运营需要，对服务内容进行新增、调整、暂停或终止。

3. 账号注册与使用

3.1 账号注册

您可以通过邮箱、Apple 登录、Google 登录或我们支持的其他方式注册或登录 calmcatch。您应保证注册和使用账号时提供的信息真实、准确、完整、合法。如果您的账号信息发生变化，您应及时更新。

3.2 账号安全

您应妥善保管自己的账号、设备、验证码和登录凭证。通过您的账号进行的操作，通常视为您本人操作。如您发现账号被盗用、异常登录或存在安全风险，应立即联系我们。因您未妥善保管账号信息、设备或登录凭证而造成的损失，由您自行承担，法律另有规定的除外。

3.3 账号限制

您不得：

1. 冒用他人身份注册或使用账号；
2. 出借、转让、出售账号；
3. 使用他人账号；
4. 利用账号进行违法、违规、侵权或破坏服务秩序的行为；
5. 通过自动化工具、脚本、爬虫等方式异常访问 calmcatch。

如我们发现您的账号存在异常、违法、违规或安全风险，我们有权采取限制登录、暂停服务、删除违规内容、终止账号等措施。

4. 免费服务与会员服务

4.1 免费服务

calmcatch 可能为免费用户提供有限次数或有限范围的功能体验，例如：

• 免费体验 AI 整理功能 3 次；
• 创建和管理基础任务、事件和笔记；
• 使用基础视图和基础提醒功能。

免费服务的具体范围以 App 内实际展示为准。我们有权根据运营需要调整免费权益。

4.2 会员服务

会员用户可获得更完整的功能权益，包括但不限于：

1. 不限次数或更高额度的 AI 整理；
2. 数据导出；
3. 数据统计；
4. 高级视图或高级筛选；
5. 云端同步或备份；
6. 后续新增的会员专属功能。

会员权益、价格、周期、试用规则和限制条件以 App 内订阅页面展示为准。

4.3 订阅价格

calmcatch 可能提供以下订阅方案：

• 月会员：US$7.99 / 月
• 年会员：以 App 内订阅页面展示价格为准

具体价格可能因地区、币种、平台、促销活动、税费或汇率而不同。最终价格以 App Store 或应用内支付页面显示为准。

4.4 自动续费

如果您购买自动续费订阅，订阅将在当前周期结束前按照平台规则自动续费，除非您在续费前主动取消。自动续费的扣款、取消、退款和账单管理通常由 App Store 或其他支付平台处理。您可以在对应平台的订阅管理页面中管理或取消订阅。删除 calmcatch 或注销 calmcatch 账号，不会自动取消您在 App Store 或其他平台开通的自动续费订阅。

4.5 取消订阅

您可以通过以下方式取消订阅：

• iOS 用户：进入 Apple ID 的“订阅”管理页面取消；
• 其他支付渠道用户：按照对应支付渠道提供的取消方式操作。

取消订阅后，您通常仍可在当前已付费周期内继续使用会员权益。当前周期结束后，会员权益将自动停止。

4.6 退款

除非适用法律另有规定，或支付平台规则允许退款，已支付的会员费用通常不予退还。通过 App Store 支付的订单，退款申请一般由 Apple 处理，我们无法直接决定退款结果。

5. AI 整理功能说明

5.1 AI 结果仅供参考

calmcatch 的 AI 整理功能用于辅助您整理输入内容。AI 可能根据上下文生成任务、事件、笔记、开始时间、持续时间或其他建议。AI 输出结果可能存在不准确、不完整、不适合当前情境或理解错误的情况。您应自行检查、确认和修改 AI 生成结果。

5.2 不构成专业建议

calmcatch 不是医疗、心理咨询、法律、财务、投资或其他专业服务工具。AI 整理结果不构成任何专业建议、诊断、治疗方案、法律意见、投资建议或决策依据。如果您需要专业帮助，请咨询相应领域的专业人士。

5.3 用户责任

您应对自己输入的内容、采纳 AI 建议后的行为和结果负责。对于因您依赖 AI 结果而产生的误会、遗漏、延误、损失或争议，在法律允许的范围内，我们不承担责任。

5.4 禁止输入违法或高风险内容

您不得使用 AI 整理功能输入、生成或处理以下内容：

1. 违法、暴力、恐怖、极端主义内容；
2. 侵犯他人隐私、名誉、知识产权或其他合法权益的内容；
3. 骚扰、歧视、仇恨、威胁或侮辱性内容；
4. 色情、低俗或未成年人不宜内容；
5. 恶意代码、网络攻击、诈骗或其他危害网络安全的内容；
6. 其他违反法律法规、公序良俗或平台规则的内容。

6. 用户内容

6.1 内容归属

您在 calmcatch 中创建、输入、上传或保存的用户内容，相关权益仍归您或原权利人所有。您授予我们一项必要的、非独占的、全球范围内的许可，用于在提供 calmcatch 服务的必要范围内存储、处理、同步、备份、展示和传输您的用户内容。该许可仅限于实现 calmcatch 功能、保障服务运行、处理您的请求和履行法律义务所需范围。

6.2 内容合法性

您应确保您输入、上传或保存的内容合法、真实，并且不会侵犯任何第三方权益。您不得通过 calmcatch 保存、传播或处理违法违规内容。如您的内容导致第三方投诉、争议、索赔或行政处罚，您应自行承担相应责任。

6.3 内容备份

我们会尽合理努力保障数据存储和同步的稳定性，但不保证数据永不丢失。建议您定期使用数据导出功能备份重要内容。因网络异常、系统故障、第三方服务异常、用户误操作、不可抗力等原因导致的数据丢失或损坏，在法律允许的范围内，我们不承担超出法律规定的责任。

7. 日程、提醒和通知

calmcatch 可能根据您设置的任务、事件或提醒时间发送通知。提醒功能可能受设备系统设置、网络状态、通知权限、电量管理、时区设置等因素影响。我们不保证每一次提醒都能准确、及时送达。您不应将 calmcatch 作为处理紧急事项、医疗事项、法律期限、考试、航班、重大财务交易或其他高风险事项的唯一提醒工具。

8. 用户行为规范

您在使用 calmcatch 时不得从事以下行为：

1. 违反法律法规、监管要求或公序良俗；
2. 侵犯他人知识产权、隐私权、名誉权、肖像权或其他权益；
3. 干扰、破坏 calmcatch 正常运行；
4. 逆向工程、反编译、反向汇编或试图获取源代码；
5. 绕过会员限制、支付限制、访问限制或安全机制；
6. 使用外挂、脚本、机器人、爬虫等异常方式访问服务；
7. 未经授权访问、扫描、攻击服务器或数据库；
8. 上传恶意代码、病毒、木马或其他有害程序；
9. 冒充他人或虚构身份；
10. 利用 calmcatch 进行诈骗、垃圾信息传播、非法营销或其他不当行为。

如您违反本协议，我们有权根据情况采取警告、限制功能、暂停账号、删除内容、终止服务、追究法律责任等措施。

9. 知识产权

calmcatch 及其相关内容，包括但不限于：

• 软件代码；
• 界面设计；
• 图标、Logo、插画；
• 产品名称；
• 文案；
• 功能设计；
• 数据结构；
• 技术方案；

均受知识产权法律保护，除用户内容外，相关权益归我们或合法权利人所有。未经我们或相关权利人书面许可，您不得复制、修改、传播、出售、出租、反向工程或以其他方式使用 calmcatch 的任何内容。

10. 第三方服务

calmcatch 可能接入或依赖第三方服务，包括但不限于：

• Apple 登录和支付服务；
• AI 服务提供商；
• 云服务器和数据库服务；
• 数据分析服务；
• 崩溃监控服务；
• 推送通知服务。

第三方服务由其各自运营方提供，并受其服务条款和隐私政策约束。因第三方服务原因造成的服务中断、数据异常、支付失败、退款争议或其他问题，我们会尽合理努力协助处理，但不对第三方服务承担超出法律规定的责任。

11. 服务变更、中断和终止

我们可能因以下原因变更、中断或终止部分或全部服务：

1. 产品功能调整；
2. 系统维护或升级；
3. 服务器、网络或第三方服务故障；
4. 安全风险或漏洞修复；
5. 法律法规、监管要求或司法行政机关要求；
6. 不可抗力；
7. 您违反本协议或相关规则。

我们会尽合理努力提前通知您，但紧急情况除外。

12. 免责声明

在法律允许的范围内，calmcatch 按“现状”和“可用”基础提供。我们不承诺 calmcatch 一定满足您的所有需求，也不保证服务不会中断、不会出错、数据不会丢失、AI 结果完全准确或提醒一定准时送达。

对于以下情形造成的损失，我们在法律允许的范围内不承担责任：

1. 您误用、过度依赖或错误理解 calmcatch 功能；
2. 您未及时查看、确认或修改 AI 结果；
3. 您未开启通知、日历或提醒权限；
4. 设备、系统、网络、第三方服务异常；
5. 您主动删除、修改或覆盖数据；
6. 不可抗力或非我们可合理控制的原因；
7. 您违反本协议或法律法规。

13. 责任限制

在法律允许的范围内，我们对您因使用或无法使用 calmcatch 而产生的间接损失、附带损失、特殊损失、惩罚性损失或利润损失不承担责任。如果法律认定我们需要承担责任，我们的责任上限不超过您在产生争议前 12 个月内就 calmcatch 实际支付给我们的费用总额；如果您未支付任何费用，则责任上限为 US$50。上述限制不适用于法律明确禁止限制责任的情形。

14. 隐私保护

我们重视您的个人信息和隐私保护。关于我们如何收集、使用、存储、共享和保护您的信息，请阅读《calmcatch 隐私政策》。《calmcatch 隐私政策》是本协议的重要组成部分。

15. 协议更新

我们可能根据产品变化、运营需要或法律法规要求更新本协议。如果本协议发生重大变化，我们会通过 App 内通知、弹窗、邮件或其他合理方式提示您。更新后的协议自页面标明的生效日期起生效。如果您在协议更新后继续使用 calmcatch，即表示您接受更新后的协议。如果您不同意更新后的协议，应停止使用 calmcatch。

16. 账号注销和服务终止

您可以在 calmcatch 内申请注销账号，或通过以下邮箱联系我们：

账号注销后，我们将停止为您提供账号相关服务，并根据《calmcatch 隐私政策》处理您的个人信息。

请注意：

1. 账号注销后，您可能无法恢复原账号、任务、事件、笔记、统计数据和导出记录；
2. 账号注销不会自动取消 App Store 或其他支付平台的自动续费订阅；
3. 如您仍有未到期会员权益，注销账号可能导致相关权益无法继续使用；
4. 法律法规要求保留的信息，我们会依法保留。

17. 适用法律与争议解决

本协议的订立、履行、解释和争议解决，适用服务运营主体所在地或实际适用司法辖区的法律，但不排除消费者所在地法律赋予您的强制性权利。因本协议或 calmcatch 产生的争议，双方应首先友好协商解决。协商不成的，任何一方可依法向有管辖权的法院或争议解决机构提出请求。
